陈茜\u003c/p\u003e\u003cp\u003e\u003c!--AIPOS_0--\u003e烟草属于法律规定的专营、专卖物品。国家对烟草专卖品的生产、销售、进出口依法实行专卖管理，并实行烟草专卖许可证制度。\u003c/p\u003e\u003cp\u003e在未取得相关烟草专卖许可证的情况下，任何单位或者个人不得收购、运输、储存、销售烟草制品。然而，总有人为利益蒙蔽双眼，罔顾法律红线，铤而走险从事非法经营活动。\u003c/p\u003e\u003cp\u003e这不，来自陕西的老张及其子小张，就因无证贩卖卷烟61万余元被判刑。10月27日，十堰市郧西县检察院检察官向极目新闻记者介绍了案情始末。\u003c/p\u003e\u003cp\u003e老张、小张父子俩是陕西省山阳县人，常年往返于陕西省各地及湖北省毗邻县市销售粉条。\u003c!--AIPOS_1--\u003e一次偶然的机会，老张发现湖北省部分卷烟价格比陕西省售价便宜，于是就动起了歪心思，多次利用到湖北省郧西县、竹溪县等地销售粉条之机，顺便从当地超市收购卷烟带回陕西，销售给陕西省西安市的经营商户刘某、孙某等人，从中赚取差价。\u003c!--MID_AD_0--\u003e\u003c!--EOP_0--\u003e\u003c/p\u003e\u003c!--PARAGRAPH_0--\u003e\u003cp\u003e\u003c!--AIPOS_2--\u003e2025年2月，老张从郧西县某乡镇收购卷烟后驾车返回途中，被执法人员查获，现场从其驾驶车辆内查获卷烟共计64条，价值1.2万余元。随后，烟草专卖行政主管部门将该线索移送至公安机关。\u003c!--AIPOS_3--\u003e公安机关调查发现，2024年2月至2025年2月，老张多次外出收购卷烟，且收到小张通过微信账户多次转入的资金累计150余万元。父亲老张负责收购卷烟、联系销货渠道，而小张负责送货、收取货款。\u003c!--MID_AD_1--\u003e\u003c!--EOP_1--\u003e\u003c/p\u003e\u003c!--PARAGRAPH_1--\u003e\u003cp\u003e3月25日，公安机关向郧西县检察院提请审查逮捕。经审查，承办检察官认为老张、小张的行为已涉嫌\u003c!--SECURE_LINK_BEGIN_0--\u003e非法经营罪\u003c!--SECURE_LINK_END_0--\u003e，但犯罪金额尚不明确。老张辩称小张转账的150余万元中既有销售粉条款，也有销售卷烟款，且还有少量收购的卷烟并未销售。那么，老张究竟将多少钱用于收购卷烟，多少钱用于销售粉条，未贩卖的卷烟又有多少呢？\u003c!--MID_AD_2--\u003e\u003c!--EOP_2--\u003e\u003c/p\u003e\u003c!--PARAGRAPH_2--\u003e\u003cp\u003e\u003c!--AIPOS_4--\u003e针对这一问题，检察官积极引导公安机关展开进一步侦查，从扣押的老张、小张手机中提取出双方微信聊天记录、交易记录等信息，用大量证据锁定资金的来源及去向，查明了老张非法经营卷烟的金额、小张参与犯罪时间及在共同犯罪中所起的作用等事实。\u003c/p\u003e\u003cp\u003e2025年5月，该案被移送至郧西县检察院审查起诉。经审查，老张、小张违反国家规定，未取得烟草专卖许可证，贩卖卷烟61万余元，扰乱市场秩序，情节特别严重，其行为已涉嫌非法经营罪；小张在共同犯罪中起次要作用，系从犯。7月22日，郧西县检察院以非法经营罪对老张、小张二人提起公诉。\u003c!--AIPOS_5--\u003e9月18日，当地法院以非法经营罪判处老张有期徒刑五年二个月，并处罚金2万元；小张有期徒刑三年，缓刑四年，并处罚金2万元。\u003c!--MID_AD_3--\u003e\u003c!--EOP_3--\u003e\u003c/p\u003e\u003c!--PARAGRAPH_3--\u003e\u003cp\u003e记者了解到，目前，相关判决已生效。\u003c/p\u003e\u003cp\u003e承办检察官提醒：烟草经营者要增强法律意识，从正规渠道进货，切勿倒卖来路不明的烟草制品，并牢记“持证上岗”，严格遵守烟草专卖相关法律规定；广大消费者也应从正规渠道购买烟草制品，若发现非法经营行为，可及时向有关部门举报，共同维护规范有序的市场环境。\u003c/p\u003e\u003cp\u003e【法条链接】\u003c/p\u003e\u003cp\u003e《中华人民共和国刑法》：\u003c/p\u003e\u003cp\u003e第二百二十五条 违反国家烟草专卖管理法律法规，未经烟草专卖行政主管部门许可，无烟草专卖生产企业许可证、烟草专卖批发企业许可证、特种烟草专卖经营企业许可证、烟草专卖零售许可证等许可证明，非法经营烟草专卖品，情节严重的，依照刑法第二百二十五条的规定，以非法经营罪定罪处罚。\u003c!--MID_AD_4--\u003e\u003c!--EOP_4--\u003e\u003c/p\u003e\u003c!--PARAGRAPH_4--\u003e\u003cp\u003e第三条
